In November 2020, the Constitutional Court handed down judgement in which Domestic Workers in South Africa are now eligible for compensation under the Compensation for Occupational Injuries and Diseases Act (COIDA).
The terms were gazetted on Wednesday and include cover for Permanent Disablement, Temporary Total Disablement, Permanent Disablement Pensions, certain Medical Expenses and in some cases, funeral expenses to the deceased’s family.
Employers will need to register their Domestic Workers, whether they have an express contract or not, by submitting the following documents to the Compensation Fund via e-mail (RegistrationCF@labour.gov.za or CFCallcentre@labour.gov.za):
a) Completed CF-1E application form for the registration of a Domestic Worker
b) Copy of the employer & employee’s ID Book or Passports
c) Proof of the employer’s residential address
d) A copy of the employment contract, if available
The employer must also submit an ROE (Return of Earnings form) on an annual basis.
